- ACCEPTANCE OF TERMS
These terms and conditions ("Terms") govern your participation in the Max Moves program ("Program"), operated by AFL Max ("we", "us", "our").
By registering for the Program, submitting payment, or accessing any Program materials, you ("Registrant", "you") agree to be bound by these Terms. If you are registering on behalf of a school or organisation, you represent that you have the authority to bind that school or organisation to these Terms.
If you do not agree to these Terms, you must not register for or participate in the Program.
- REGISTRATION
2.1 Eligibility The Max Moves program is available to registered Australian schools and educational institutions. Registration must be completed by a teacher, school administrator or other authorised representative of the school.
2.2 Registration process To participate in the Program, you must:
- Complete the online registration form in full and provide accurate details for each class being registered
- Submit full payment at the time of invoice
- Register before the published registration closing date for the relevant program round
Registration is not confirmed until full payment has been received and a confirmation email has been issued by Max Moves.
2.3 Class registrations Each registration covers one class for the full 6-week program round. Schools registering multiple classes must register and pay for each class separately or select the applicable multi-class pricing tier at the time of registration.
2.4 Registration closing dates Registrations must be submitted and paid in full before the published closing date for each program round. AFL Max reserves the right to decline late registrations at its discretion. Registration closing dates are published on the Max Moves website.
- PAYMENT TERMS
3.1 Payment required to secure registration Payment in full is required to secure your class's place in the program. Registrations will not be confirmed, and program access will not be granted until payment has been received and cleared.
Important: Completing the registration form does not reserve your place in the program. Your registration is only confirmed once full payment has been received. Places are limited and are allocated on a first-paid basis.
3.2 Pricing
All fees are in Australian dollars (AUD) and are exclusive of GST where applicable. Pricing is per program round and does not carry over to future rounds.
3.3 Accepted payment methods AFL Max accepts payment by credit card, debit card, and bank transfer (EFT). Details of accepted payment methods are provided on invoice. Payment must be received and cleared before registration is confirmed.
For schools paying by EFT, registration will be confirmed once funds have cleared into the AFL Max account. Schools are encouraged to allow sufficient time for EFT clearance before the registration closing date.
3.4 Invoices and receipts A tax invoice will be issued by AFL Max upon receipt of payment. Invoices will be sent to the email address provided at the time of registration. It is the Registrant's responsibility to ensure the contact details provided are accurate.
3.5 Purchase orders AFL Max may accept official school purchase orders at its discretion. Purchase orders must be submitted in advance of the registration closing date and are subject to approval. Payment under a purchase order remains due and payable in full. A purchase order does not constitute confirmed registration until payment has been received.
3.6 Overdue payments Where payment is not received by the registration closing date, AFL Max reserves the right to cancel the registration and reallocate the place to another school. AFL Max accepts no liability for any loss or inconvenience arising from a registration being cancelled due to non-payment.
- PROGRAM ACCESS
4.1 Access granted on payment Access to the Max Moves platform, program materials, daily activities, and leaderboard will be granted to confirmed registrants once full payment has been received and the program round has commenced.
4.2 Platform access details Login credentials and platform access instructions will be emailed to the Registrant's nominated email address prior to the program start date. AFL Max is not responsible for access issues arising from incorrect email addresses provided at registration or for emails being filtered into spam or junk folders.
4.3 Scope of access Each registration provides access for one class for the duration of the relevant 6-week program round. Access is non-transferable and may not be shared with other classes, schools or individuals not included in the original registration.
4.4 Access period Platform access is available for the duration of the registered program round only. Access will expire at the close of the round. Program materials and activity content are not available outside of the active program period unless otherwise agreed in writing by AFL Max.
4.5 Technical requirements Access to the Max Moves platform requires a stable internet connection and a compatible device. AFL Max does not warrant that the platform will be available on all devices or browsers. It is the Registrant's responsibility to ensure adequate technical access prior to the program commencing.
- CANCELLATION AND REFUNDS
5.1 Cancellation by the Registrant Cancellation requests must be submitted in writing to AFL Max via email. The following cancellation policy applies:
- More than 14 days before the program start date: A full refund will be issued, less a $75 administration per school.
- 7 to 14 days before the program start date: A 50% refund of the total registration fee will be issued.
- Less than 7 days before the program start date: No refund will be issued. The registration fee is non-refundable.
- After the program has commenced: No refund will be issued under any circumstances.
5.2 Transfers Registration may be transferred to another class within the same school at no additional cost, provided the request is made in writing at least 7 days before the program start date. Transfers to another school or organisation are not permitted.
5.3 Cancellation by AFL Max AFL Max reserves the right to cancel a program round in the event of insufficient registrations, unforeseen circumstances, or circumstances beyond its reasonable control. In such cases, Registrants will receive a full refund of fees paid. AFL Max accepts no further liability arising from a program cancellation.
5.4 Refund processing Approved refunds will be processed within 10 business days of the cancellation being confirmed in writing by AFL Max. Refunds will be issued to the original payment method used at the time of registration.
Note on Australian Consumer Law: Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law. Where a consumer guarantee applies, AFL Max will provide a remedy in accordance with the Australian Consumer Law.
- PARTICIPANT CONDUCT
6.1 Appropriate use Registrants and participating students are expected to use the Max Moves platform and program materials in good faith and in accordance with these Terms. The program is designed to encourage physical activity and positive engagement in the classroom.
6.2 Accurate point logging Points must only be logged upon genuine completion of the relevant daily activity by the registered class. Logging points for activities not completed, or manipulating point totals in any way, is a breach of these Terms and may result in immediate disqualification from the program and leaderboard without refund.
6.3 Leaderboard integrity AFL Max reserves the right to review, adjust, or remove any points or leaderboard entries it reasonably suspects to be the result of inaccurate logging, system manipulation, or any other conduct inconsistent with the spirit of the program. AFL Max's decision on leaderboard matters is final.
6.4 Disqualification AFL Max reserves the right to disqualify a registered class or school from the program, including from prize eligibility, without refund, where it determines that conduct has breached these Terms or is otherwise contrary to the fair and positive intent of the program.
- INTELLECTUAL PROPERTY
7.1 Ownership All content, materials, activities, platform features, branding, and other intellectual property forming part of the Max Moves program ("Program IP") are owned by or licensed to AFL Max and are protected by Australian and international intellectual property laws.
7.2 Limited licence Upon confirmed registration and payment, AFL Max grants the Registrant a limited, non-exclusive, non-transferable licence to access and use the Program IP solely for the purpose of participating in the registered program round with their registered class. This licence does not permit:
- Reproduction, distribution, or publication of program materials to any party outside the registered class
- Use of program materials in future rounds or for any other purpose without a separate registration and payment
- Modification, adaptation, or creation of derivative works from any program materials
- Commercial use of any program content or materials
7.3 Feedback and submissions Any feedback, suggestions, or ideas submitted to AFL Max regarding the program may be used by AFL Max without restriction or compensation to the Registrant.
- DATA AND PRIVACY
8.1 Collection of personal information AFL Max collects personal information from Registrants including name, school name, email address, and payment details for the purpose of administering the program, processing payment, and communicating with Registrants about the program.
8.2 Student data AFL Max does not require the collection of individual student personal information to participate in the program. Registrants are responsible for ensuring that any data entered into the platform on behalf of students complies with their school's privacy obligations and applicable law.
8.3 Privacy Policy The collection, use, and storage of personal information by AFL Max is governed by our Privacy Policy, available on the Max Moves website. By registering for the program, you consent to the collection and use of your personal information as described in the Privacy Policy.
8.4 Marketing communications By registering, you agree to receive program-related communications from AFL Max about the Max Moves program. You may also receive information about future program rounds and Max Moves offerings. You may opt out of marketing communications at any time by contacting us or using the unsubscribe link in any email communication.
- LIMITATION OF LIABILITY
9.1 Program delivery AFL Max will use reasonable endeavours to deliver the program as described. However, AFL Max does not warrant that the program, platform, or any content will be free from errors, interruptions, or technical issues.
9.2 Platform availability AFL Max does not guarantee uninterrupted or error-free access to the platform. Scheduled or unscheduled maintenance, technical issues, or circumstances beyond AFL Max's control may temporarily affect platform availability. AFL Max will use reasonable endeavours to minimise disruption and restore access promptly.
9.3 Limitation To the maximum extent permitted by law, AFL Max's total liability to a Registrant arising out of or in connection with the program, these Terms, or any registration is limited to the total fees paid by that Registrant for the relevant program round.
AFL Max is not liable for any indirect, consequential, special, or incidental loss or damage arising from participation in the program or use of the platform, including but not limited to loss of data, loss of reputation, or costs of substitute services.
9.4 Physical activity The program involves physical movement activities. It is the responsibility of the Registrant, the teacher, and the school to ensure that activities are conducted safely and are appropriate for the students involved. AFL Max accepts no liability for any injury, illness, or other harm arising from participation in program activities.
- CHANGES TO THE PROGRAM
10.1 Program content AFL Max reserves the right to modify, update, or replace program activities, materials, and platform features at any time without notice. Changes will not affect the fundamental nature of the program as a 6-week curriculum-aligned classroom movement challenge.
10.2 Pricing Fees published at the time of registration are fixed for that registration. AFL Max reserves the right to update pricing for future program rounds. Updated pricing will be published on the Max Moves website and will not apply to existing confirmed registrations.
10.3 Changes to these Terms AFL Max may update these Terms from time to time. The current version of these Terms will always be available on the Max Moves website. Your continued participation in the program following any update constitutes acceptance of the revised Terms. Material changes will be communicated to Registrants by email.
- GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Australia. Any disputes arising out of or in connection with these Terms or the program will be subject to the exclusive jurisdiction of the courts of Australia.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
These Terms constitute the entire agreement between AFL Max and the Registrant with respect to the subject matter and supersede all prior communications, representations, or agreements.
